FRISCO KIDS STROLLER RENTALS RENTAL AGREEMENT AND LIABILITY WAIVER

This Rental Agreement and Liability Waiver ("Agreement") is entered into between Morrow Folk Co LLC, doing business as Frisco Kids Stroller Rentals ("Company"), and the individual completing the reservation ("Client").

Frisco Kids Stroller Rentals remains the sole owner of all rental equipment. The Company is not selling equipment, and the Client is not purchasing equipment. All equipment is provided solely on a temporary rental basis for personal use.

By placing a reservation, making payment, accepting delivery, or using any rented equipment, the Client acknowledges that they have read, understood, and agree to be bound by all terms and conditions contained in this Agreement.

RESERVATIONS AND PAYMENT

The Client's reservation details are incorporated into this Agreement by reference.

Full payment is required at the time of booking unless otherwise agreed by the Company. Payment may be made by credit card, debit card, or other approved payment methods.

The Client authorizes Frisco Kids Stroller Rentals to process refunds, adjustments, damage charges, replacement charges, late fees, delivery fees, and any other charges authorized under this Agreement using the payment method on file.

Reservation confirmations will be sent by email. It is the Client's responsibility to verify that the reservation information is accurate and to contact the Company if a confirmation is not received within 24 hours of booking.

Equipment colors, styles, and accessory configurations may vary from photographs displayed on the website or marketing materials.

DELIVERY, POSSESSION, AND USE

At the time of reservation, the Client shall provide the delivery and pickup location, including hotel, vacation rental, residence, or other approved location.

Delivery and pickup procedures may vary by location. Delivery windows and pickup instructions will be provided to the Client prior to the rental period.

The Company currently services Frisco, Texas and surrounding North Texas communities, including but not limited to Plano, McKinney, Prosper, Little Elm, The Colony, Celina, and selected areas within the Dallas-Fort Worth Metroplex. Service areas may be modified at any time at the Company's discretion.

The Client agrees to notify the Company promptly if they are unable to locate delivered equipment or if delivery instructions require clarification.

Requests to modify a reservation must be submitted at least 24 hours before the scheduled delivery time. Requests made within 24 hours may be accommodated at the Company's sole discretion.

The Client agrees to maintain possession and control of all rented equipment throughout the rental period. Equipment must be stored in secure locations when not in use and may not be abandoned, left unattended in public areas, or entrusted to third parties without prior approval from the Company.

The Client shall inspect all equipment upon receipt and notify the Company immediately of any defects, damage, or operational concerns.

The Client agrees to use all rental equipment only for its intended purpose and in accordance with manufacturer instructions and weight limitations.

The Company reserves the right to terminate any rental agreement if equipment is being misused, abused, or operated in violation of this Agreement. In such circumstances, the Client shall immediately return all rented equipment upon request.

RETURN OF EQUIPMENT

The Client agrees to return all rental equipment on the agreed return date, time, and location specified in the reservation.

If the Client wishes to extend the rental period, the Client must contact the Company before the scheduled return time. Extensions are subject to equipment availability and Company approval.

Late returns may be charged at the applicable daily rental rate plus any additional administrative, recovery, or delivery fees incurred by the Company.

The Client agrees to notify the Company immediately if circumstances arise that may delay the return of rented equipment.

DAMAGE, LOSS, AND REPLACEMENT

The Client accepts full responsibility for all rented equipment while it is in their possession.

The Client is responsible for any loss, theft, damage, destruction, or excessive soiling of rental equipment occurring during the rental period, regardless of cause.

The Client authorizes the Company to charge the payment method on file for repair costs, cleaning fees, replacement parts, or full replacement value of equipment that is lost, stolen, damaged beyond repair, or not returned.

The Client agrees to immediately notify the Company of any loss, theft, damage, accident, or malfunction involving rented equipment.

LIABILITY WAIVER

The Client acknowledges that the use of strollers and other rental equipment involves inherent risks.

The Client voluntarily assumes all risks associated with the use, operation, transportation, and possession of rented equipment.

Frisco Kids Stroller Rentals, Morrow Folk Co LLC, its owners, officers, employees, contractors, affiliates, and representatives shall not be liable for any injury, illness, death, property damage, economic loss, or other damages arising out of or related to the use or misuse of rental equipment.

To the fullest extent permitted by Texas law, the Client releases, waives, discharges, and agrees to hold harmless Frisco Kids Stroller Rentals, Morrow Folk Co LLC, its owners, employees, contractors, and affiliates from any and all claims, liabilities, damages, losses, expenses, or causes of action arising from the use of rented equipment.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas.

Any dispute arising under this Agreement shall be resolved exclusively in the state or federal courts located in Collin County, Texas.

SMS COMMUNICATION CONSENT

By providing a mobile phone number, the Client consents to receive text messages regarding reservations, deliveries, pickups, updates, and customer service communications from Frisco Kids Stroller Rentals.

Message and data rates may apply. Message frequency varies.

Clients may opt out at any time by replying STOP to any text message received.

For assistance, Clients may reply HELP or contact the Company directly.

PRIVACY

Frisco Kids Stroller Rentals respects customer privacy and does not sell customer information to third parties. Information collected during the reservation process is used solely for business operations, reservation management, customer communications, legal compliance, and service improvement.

ACKNOWLEDGEMENT

By completing a reservation, accepting delivery, or using rental equipment, the Client acknowledges that they have carefully read this Agreement, fully understand its contents, and voluntarily agree to all terms and conditions.

ADDITIONAL TERMS AND CONDITIONS

ELECTRONIC ACCEPTANCE

By completing an online reservation, checking any acceptance box, electronically signing, making payment, accepting delivery, or using rented equipment, the Client agrees that such actions constitute a legally binding electronic signature and acceptance of this Agreement. Electronic records and signatures shall be deemed valid and enforceable to the fullest extent permitted by applicable law.

CLEANING AND SANITIZATION

Frisco Kids Stroller Rentals takes pride in providing clean and sanitized equipment. All rental equipment is cleaned and inspected between rentals.

The Client agrees to return equipment in reasonably clean condition. Normal dirt and wear associated with family use is expected and accepted.

The Company reserves the right to assess additional cleaning fees for equipment returned with excessive dirt, mud, food residue, bodily fluids, pet hair, smoke odor, stains, or other conditions requiring extraordinary cleaning.

Cleaning fees may range from $25 to $150 depending on the severity of the condition and the cost required to restore the equipment to rentable condition.

WEATHER AND WATER DAMAGE

The Client is responsible for protecting rented equipment from rain, flooding, excessive moisture, and other weather-related conditions.

The Company recommends that equipment not be left outdoors unattended.

Damage resulting from exposure to rain, standing water, flooding, mold, mildew, rust, or similar environmental conditions may result in repair, cleaning, or replacement charges.

Frisco Kids Stroller Rentals does not guarantee replacement equipment in the event of weather-related damage.

LOST, STOLEN, OR ABANDONED EQUIPMENT

The Client remains fully responsible for all rented equipment until it has been physically returned to and accepted by Frisco Kids Stroller Rentals.

Equipment left unattended in public areas, parking lots, theme parks, airports, shopping centers, hotels, vacation rentals, transportation services, or other locations may be considered abandoned.

The Client shall be responsible for all costs associated with recovering abandoned equipment, including transportation, recovery, administrative, and replacement costs.

If equipment is believed to be stolen, the Client must notify the Company immediately and file a police report within 24 hours.

REPLACEMENT VALUE SCHEDULE

The following replacement values represent typical replacement costs and may be adjusted based on current market pricing:

Single Stroller: Up to $600

Double Stroller: Up to $900

Tandem Double Stroller: Up to $1,200

Wagon Stroller: Up to $1,500

Infant Car Seat: Up to $400

Parent Organizer: Up to $50

Rain Cover: Up to $75

Snack Tray: Up to $75

Cup Holder: Up to $30

Safety Harness Components: Up to $150

Lost Keys, Locks, or Security Devices: Up to $100

The Client authorizes Frisco Kids Stroller Rentals to charge the payment method on file for repair or replacement costs as necessary.

SAFETY REQUIREMENTS

The Client agrees to follow all manufacturer instructions, warnings, and safety guidelines.

The Client shall not:

  • Exceed stated weight limits.
  • Allow children to stand in strollers not designed for standing.
  • Modify, alter, or remove safety components.
  • Leave children unattended in rental equipment.
  • Use equipment in a reckless, unsafe, or unintended manner.

Failure to comply with safety requirements may void any optional protection plan and may result in termination of the rental.

OPTIONAL DAMAGE PROTECTION PLAN

If offered by the Company and purchased by the Client, the Optional Damage Protection Plan may reduce the Client's responsibility for certain accidental damage.

The Optional Damage Protection Plan does not cover:

  • Theft
  • Loss
  • Abandonment
  • Intentional damage
  • Gross negligence
  • Damage caused by misuse
  • Damage caused by unauthorized modifications
  • Missing accessories or components
  • Damage caused by pets
  • Damage resulting from failure to follow manufacturer instructions

The Company retains sole discretion in determining whether damage qualifies for protection under the Optional Damage Protection Plan.

PHOTO AND TESTIMONIAL CONSENT

The Client grants Frisco Kids Stroller Rentals permission to use reviews, testimonials, and photographs voluntarily submitted by the Client for marketing and promotional purposes.

No personal identifying information will be used without permission.

Clients may revoke this consent at any time by providing written notice.

FORCE MAJEURE

The Company shall not be liable for delays, interruptions, cancellations, or inability to perform due to circumstances beyond its reasonable control, including but not limited to:

  • Severe weather
  • Flooding
  • Tornadoes
  • Power outages
  • Vehicle breakdowns
  • Road closures
  • Government actions
  • Public emergencies
  • Natural disasters

In such circumstances, the Company's liability shall be limited to the amount paid by the Client for the affected rental period.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, the total liability of Frisco Kids Stroller Rentals, Morrow Folk Co LLC, its owners, employees, contractors, and affiliates shall not exceed the total rental fees paid by the Client.

Under no circumstances shall the Company be liable for indirect, incidental, consequential, special, or punitive damages.

SEVERABILITY

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the Client and Frisco Kids Stroller Rentals and supersedes all prior communications, representations, or agreements relating to the rental equipment.
